The property split doesn’t have to be 50/50, although it often ends up that way. Marital property includes everything, minus gifts and inheritance, which a couple has acquired during the marriage. This list can include houses, cars, military pensions, 401(k) accounts, and other personal property. Equity and interest are also included. The amount of interest and 401(k) money that the other spouse receives depends on how long the couple has been married. The sooner you get a divorce, the less capital gain the other spouse gets in the final divorce property settlement. Parenting Rights and ResponsibilitiesEven if the parents are no longer together, they have to work together if there are children involved. Parents (or the court) must decide where their children will live, who will make decisions about their lives, and how much child support the non-custodial spouse will pay. Unless the two parties agree on another, higher number, child support is calculated in a formula determined by statutory child support guidelines.
