Jurisdictional Issues in Military Divorces

If you want to get divorced in Colorado, one party must be a Colorado resident. With a military divorce, often one or both spouses will be legal residents of another state, even if they are deployed from Fort Carson, Peterson AFB, or Schriever AFB. Before we can file for a Colorado divorce, we have to determine which court has jurisdiction.

The test for jurisdiction is twofold. First, there must be jurisdiction of the person, over both you and your spouse. Second, there must be subject matter jurisdiction. Jurisdiction can be a confusing subject. DFAS and Military Pensions

In Colorado, all military pensions and military retirement benefits, payable through the Defense Finance and Accounting Service (DFAS), are subject to the marital property rule. Any assets acquired during the marriage count as marital property, including any DFAS benefits. Therefore, they will be divided by the court as part of the divorce settlement unless waived.

If a military spouse is married for more than 20 years, he or she will get medical benefits for life after the divorce. If the spouse is disabled, it might make sense for them to not file right away so that he or she can receive these medical benefits.
